7/12 Extract Explained: Who Really Owns That Plot in Sindhudurg ?

Part 2 of my Konkan Land Compliance Series

Konkan land is a strong investment, but only when the ownership behind it is clean. A plot can pass every site visit and still carry a loan, a dispute or a seller who is not the recorded owner.

I work with investors across Sindhudurg and Goa, and I check every property for legal compliance before it reaches a client. I do it in four layers:

📍 Layer 1: Can you build here? (CRZ zoning)

📍 Layer 2: Who really owns it? (7/12 extract)

📍 Layer 3: Is the land and project approved? (RERA and NA)

📍 Layer 4: Is the conversion formally granted? (Sanad)

In Part 1, we covered CRZ. This post covers Layer 2: the 7/12 extract, the first document I read on any Maharashtra plot.

WHAT IS A 7/12 EXTRACT?

The 7/12, also called the Satbara utara, is a land record maintained by the Maharashtra revenue department. It combines two village forms:

📍 Form 7: the record of rights, which shows who holds the land and on what terms

📍 Form 12: the crop and land-use register, which shows how the land is being used

A recent, digitally signed copy can be downloaded through the state’s Mahabhulekh land records portal. Always ask for a recent copy, not an old printout.

WHAT YOU WILL FIND ON A 7/12

✅ Survey or Gat number: the plot’s identity. It must match every other document and the CRZ map from Part 1.

✅ Area: shown in hectares and ares. Compare it with the area in the sale deed.

✅ Owner name (khatedar): the person the government records show as holder.

✅ Occupancy class: tells you how freely the land can be transferred.

✅ Other rights (itar adhikar): where loans, mortgages and other claims are recorded.

✅ Cultivation details: how the land has been used.

7/12 VS 8A, AND WHY MUTATION MATTERS

The 8A extract lists all land held by one owner in a village, which helps you check whether a seller owns what they claim.

When land is sold, inherited or divided, the change should be entered through a mutation entry (ferfar). If a sale was registered but the entry was never made, the 7/12 can still show the old owner. That mismatch is one of the most common causes of land disputes.

A 7/12 is a revenue record. It is not, by itself, proof of title. Title is established through the registered chain of deeds. Use the 7/12 as the first check, then let a lawyer’s title search confirm the rest.

SINDHUDURG VS GOA: QUICK COMPARISON

📌 Core record: Sindhudurg uses the 7/12 and 8A. Goa uses the Form I and XIV extract.

📌 Ownership history: Sindhudurg shows it through mutation (ferfar) entries. Goa shows it through the survey records and deeds, which a local lawyer should trace.

📌 Special issues: Goa has comunidade land, which is not freely saleable, and mundkars, occupants with legal protection from eviction. Maharashtra buyers rarely face either.

📌 Best practice in both: a title search covering at least 30 years.

THE 7/12 PAPERWORK CHECKLIST

🗂️ Recent 7/12 and 8A. Digitally signed, for the exact survey number.

🗂️ Owner match. The seller’s name and ID must match the record and the sale deed.

🗂️ Area and survey number match. Check them against every other document.

🗂️ “Other rights” column. Look for loans, mortgages and tenancy entries.

🗂️ Mutation history. Confirm how ownership reached the current owner.

🗂️ Occupancy class. Check for restrictions on transfer.

🗂️ Co-owners. Confirm all co-owners are signing the sale.

🗂️ Title search. At least 30 years, with a litigation check.

🗂️ Next layers. RERA, NA status and sanad are covered in the next parts.

THREE RED FLAGS TO WALK AWAY FROM

🚩 The seller’s name is not on the current record, or a mutation is pending

🚩 A loan, tenant or dispute entry that nobody can explain or clear

🚩 Several co-owners, but only one is selling

A note for NRI investors: the 7/12 also shows whether the land is classified as agricultural. As mentioned in Part 1, NRIs and OCIs cannot buy agricultural land, plantations or farmhouses in India, so check this before you proceed.

WHY THIS CHECK PROTECTS YOUR RETURNS

A clean, current 7/12 with a clear mutation history makes a plot easier to finance, build on and resell. An unclear record can delay registration, block a bank loan or become a court case years after you bought.

THE BOTTOM LINE

CRZ tells you whether you can build. The 7/12 tells you who holds the land and what claims sit on it. Read it yourself, then have a lawyer confirm the title behind it.

Next in the series: RERA and NA conversion, which shows whether the project and the land use are legally approved.
